NOTE TO FILE According to the Department of the Interior's Solicitor's Office, the Lowell Historic Preservation District, in Lowell, MA, was administratively listed in the National Register of Historic Places on January 19, 2001, when the Secretary of the Interior delegated to the Director of the National Park the authority to administer the Lowell Historic Preservation District. According to the law that established the Lowell Historic Preservation District (16 USC Sec. 410cc-11) the boundary of the district is depicted on the map entitled "Lowell National Historical Park, Massachusetts," dated March, 1978, and numbered "Lowe-80,008A." Establishment of Lowell National Historical Park - (a) Establishment and administration of Lowell Historic Preservation District - (1) To carry out the purpose of this subchapter, there is established as a unit of the National Park System in the city of Lowell, Massachusetts, the Lowell National Historical Park. There is further established in an area adjacent to the park the Lowell Historic Preservation District, which will be administered by the Secretary and by the Commission in accordance with this subchapter. The boundaries of the park and preservation district shall be the boundaries depicted on the map entitled "Lowell National Historical Park, Massachusetts", dated March 1978, and numbered "Lowe - 80,008A".
Such map shall be on file and available for inspection in the office of the National Park Service, Department of the Interior, and in the office of the city clerk, city of Lowell.
- (2) The Secretary shall publish in the Federal Register, as soon as practicable after June 5, 1978, a detailed description and map of the boundaries established under paragraph (1) of this - (b) Boundary revisions; publication The Secretary may make minor revisions of the park and preservation district boundaries established under subsection (a)(1) of this section, after consulting with the Commission and the city manager of Lowell, by publication of a revised drawing or other boundary description in the Federal Register; but no waters, lands, or other property outside of the park or preservation district boundaries established under such subsection may be added to the park or preservation district without the consent of the city manager of Lowell and the city council of Lowell.
A boundary revision made under this subsection shall be effective only after timely notice in writing is given to the Congress.

A. The Director is authorized, except as provided in 200 DM 1, to exercise the program authority of the Secretary of the Interior with respect to the supervision, management, and operation of the National Park System. B. The Director is authorized to exercise the authority of the Secretary of the Interior to issue such rules and regulations as would amend by addition, revision, or revocation, regulations contained in Chapter 1, Title 36, Code of Federal Regulations, and Title 43, Code of Federal Regulations in so far as it relates to the National Recreation Areas of the National Park System. C. The Director is delegated the Secretary's authority: (1) To carry out the purposes of the Wild and Scenic Rivers Act (82 Stat. 906; 16 U.S.C. 1271 et seq.) and the National Trails System Act (82 Stat. 919; 16 U.S.C.
1241 et seq.) regarding additions to and evaluations of components of the systems and, in accordance with 710 DM 1, the selection and location of boundaries, property acquisition, development, and administration of assigned components of the systems. (2) For enforcement as specified in Section 8 (b) of the Wild Free-Roaming Horse and Burro Act of 1971 (85 Stat. 649; 16 U.S.C. 1331-1340). This authority will be exercised in accordance with the provisions of 633 DM 1. I had referred Christine Beard (consultant with Tremont Preservation Services) to you because she has requested written confirmation from NPS that the Lowell National Historic Park and Preservation District is considered listed on the NR. You might remember that there has been continued confusion about this district's status. Years ago, we had an incomplete draft, but never received revisions or a final copy from the Park. I'm not sure whether anything was ever sent down to you by the Park, but I recall that there was considerable discussion at one point about who should be reviewing this and when. I heard recently that the preservation district's staff person was preparing to submit final documentation, though I'm not sure what form that will take.
I realize that vou don't have access to the Register files at the moment, so perhaps this will have to wait for an actual resolution, but Chris is anxious because of the tax act projects with which she is involved.
